Resumen de Aspectos notariales de la Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotercaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales

  El presente trabajo tiene por objetivo hacer un breve comentario a la Ley 17/2021, de 15 de diciembre, de modificación del Código Civil, la Ley Hipotecaria y la Ley de Enjuiciamiento Civil, sobre el régimen jurídico de los animales, vigente desde el 5 de enero de 2022, en el que, junto a sus aspectos generales, se destacan los asuntos que más pueden afectar a la función notarial, en cuanto mecanismo de justicia preventiva de conflictos y de fraudes a la ley, en materias tan importantes como las garantías del crédito (hipoteca, prenda...), en sede sucesoria, así como en caso de crisis familiares, de mutuo acuerdo y sin hijos menos no emancipados o mayores respecto de los que se hayan establecido judicialmente medidas de apoyo atribuidas a sus progenitores, que se pretendan homologar por la vía notarial.

  The objetive of this work is to make a brief comment on Law 17/2021, of December 15, modifying the Civil Code, the Mortgage Law and the Civil Procedure Law, on the legal regime of animals, in force since 5 of January 2022, in which, together with its general aspects, the issues that can most affect the notarial function are highlighted, as a preventive justice mechanism for conflicts and fraud of the law, in matters as important as guarantees of credit (mortgage, pledge...), in inheritance, as well as in case of family crises, by mutual agreement and without minor children, who intend to homologate by notarial means.
