    Se estudia en este artículo la regulación de los mandatos y poderes preventivos tras la reforma realizada por la Ley 8/2021: naturaleza jurídica, quiénes pueden otorgarlos y a quiénes se pueden conferir, los supuestos de pluralidad de apoderados, la configuración de las facultades, con la posibilidad de salvar la autocontratación y el conflicto de intereses, el contenido, controles y salvaguardas, la sustitución, su puesta en vigor y ejercicio, la escritura pública para su otorgamiento, su inscripción registral, su revisión y extinción, concluyendo con una referencia a la regulación de Derecho Foral y de Derecho Comparado, así como a los problemas que se pueden plantear en Derecho Interregional e Internacional Privado.

    This article studies the regulation of preventive mandates and powers, after the reform carried out by Law 8/2021: legal nature, who can grant them and to whom they can be conferred, the assumptions of plurality of attorneys, the configuration of the powers, with the possibility of saving the self-contracting and the conflict of interests, the content, controls and safeguards, the substitution, its implementation and exercise, the public deed for its granting, its registration, its review and extinction, concluding with a reference to the regulation of Foral Law and Comparative Law, as well as the problems that may arise in Interregional and International Private Law.
