  Este texto indaga en los conceptos y los procesos históricos que derivan en el otorgamiento del poder constituyente a un grupo de representantes (legisladores) para que elaboren una nueva (o reciente) carta magna. La Constitución es el marco general en el que se basan los sistemas democráticos para la gobernanza, de ahí que su reforma o redacción constituyan ocasiones excepcionales en la historia de un país. La Asamblea Constituyente se instala por mandato del pueblo, que ejerce de soberano al exigir su instalación y funcionamiento como producto de una revolución o de un cambio exigido por otras coyunturas históricas. Este ensayo se ocupa de definir y contextualizar el poder constituyente y su vinculación con los derechos humanos.PALABRAS CLAVE: poder constituyente; poder constituyente originario; poder constituyente derivado.

  Human rights and constituent powerABSTRACTThis text investigates the concepts and historical processes that lead to the granting of constituent power to a group of representatives (legislators) to prepare a new (or recent) Magna Carta. The Constitution is the general framework on which democratic systems for governance are based, hence its reform or drafting constitute exceptional occasions in the history of a country. The Constituent Assembly is installed by mandate of the people, who exercise sovereignty by demanding its installation and operation as a product of a revolution or a change required by other historical conjunctures.
