The Joint Sections of the Court of Cassation face the issue regarding the fate of the omnibus personal guarantees stipulated applying the uniform scheme provided by the ABI (Italian Banking Association) —agreement in violation of the fair competition, which is null according to article 2 of the Law n. 287/90 andarticle 101 TFEU — without reaching a solution deemed to be convincing from a dogmatic point of view. With the aim to present an autonomous reconstructive proposal, it seems, thus, necessary to begin with a two-fold assessment: on one side, examining the approaches arisen until now amid the debates both among scholars and through the case law; on the other side, verifying the practical feasibility of the outcomes towardwhich such propositions lead.
Le Sezioni Unite affrontano la questione relativa alla sorte delle fideiussioni omnibus concluse inapplicazione dello schema uniforme predisposto dall’ABI — intesa anticoncorrenziale nulla ex art. 2, l.
287/90 e art. 101 TFUE — senza giungere ad una soluzione dogmaticamente convincente. Sembra allora necessario ripartire dall’analisi delle impostazioni sinora emerse nel dibattito dottrinale e giurisprudenziale, e della concreta percorribilità degli esiti cui queste giungono, al fine di avanzare un’autonoma proposta ricostruttiva.
