    • This note seeks to set out the main things that should be borne in mind when acting as an expert witness. It is the fi rst of a pair of notes; the second will consider the key issues when working as an expert witness within the UK. The two notes should therefore be read together. This note applies both to those who are considering acting as an expert witness and to those who have done so before.

      Acting as an expert witness is a serious undertaking and the implications of an expert witness’s work can be considerable. To act as an expert witness requires impartiality, considerable skill and expertise. This is not always appreciated by expert witnesses across the professions in which they practise and the courts have been critical of the work and conduct of some expert witnesses in the past.
