This study refers to the first chapter of the judicial processconcerning crimes perpetrated by rubber tappers installed in the Amazonregion of Putumayo, in Peru, during the 1910s, which generated thebook El Proceso de Putumayo y sus Secretos Inauditos (Iquitos, Perú:CETA, 2004). The author Carlos A. Valcárcel, first judge of the process,produces a final text that goes beyond the perspective of the jurisconsultand prints the humanist vision in line with the dawn of the 20th century.The chapter under translation for this study – The crimes of Putumayo – isconstructed by a discourse that frankly assumes a posture of indignationdue to the blatant irresponsibility and omission of the Peruvian penalsystem, which provoked the criminals’ impunity and the only historicalpenalty, of the criminals. indigenous people who suffered genocide.Therefore, the translation of this chapter reveals the evident break of the objective judicial discourse and shows us an author-judge frankly taken by opinion and indignation.

Este estudo se refere ao primeiro capítulo do processo judicial acerca dos crimes perpetrados por seringalistas instalados na região amazônica do Putumayo, no Perú, durante a década de 1910, que gerou o livro El Proceso de Putumayo y sus secretos inauditos (Iquitos, Perú: CETA,2004). O autor Carlos A. Valcárcel, primeiro juiz do processo, produz um texto final que vai além da perspectiva do jurisconsulto e imprime a visão humanista coadunada com o alvorecer do século XX. O capítulo sob tradução para este estudo – Os crimes de Putumayo – é construído por um discurso que francamente assume postura de indignação em razão dadeslavada irresponsabilidade e omissão do sistema penal peruano, o que provocou a impunidade dos criminosos e a única penalidade histórica, dos próprios indígenas que sofreram genocídio. Por isso, a tradução deste capítulo revela a quebra evidente do discurso objetivo judiciário e nos mostra um autor-juiz francamente tomada por opinião e indignação.
