El presente trabajo analiza el voto en el caso de los Pueblos Indígenas Kuna de Madungandí y Emberá de Bayano y sus miembros vs. Panamá, en el cual la Corte Interamericana de Derechos Humanos (en adelante “la Corte” o “el Tribunal Interamericano”) acoge la excepción preliminar interpuesta por el Estado relativa a la falta de competencia ratione temporis y, por tanto, dispone que no entrará al estudio de fondo del caso en lo relativo al pago de las indemnizaciones que el Estado debió de realizar.
This paper analyzes the vote in the case of the Kuna Indigenous Peoples of Madungandí and Emberá de Bayano and their members vs. Panama, in which the Inter-American Court of Human Rights (hereinafter “the Court” or “the Inter-American Court”) welcomes the preliminary objection filed by the State regarding the lack of competence ratione temporis and, therefore, provides that it will not enter to the substantive study of the case in relation to the payment of the compensation that the State had to carry out.
