    La presente investigación tiene como objeto realizar un estudio multidisciplinar acerca del delito de incendio forestal tanto a nivel jurídico como operativo, aproximando y poniendo de relevancia la actuación de las Fuerzas y Cuerpos de Seguridad del Estado. Como bien es sabido, la quema de zonas forestales a lo largo del territorio nacional es una constante y, a menudo, las vías que tiene el Estado para combatir este comportamiento ilícito son insuficientes, ocasionando enormes pérdidas y un profundo quebranto en nuestra biodiversidad. Al mismo tiempo, la respuesta jurídico penal – especialmente al agravar el tipo penal – parece ser inadecuada al dejar cierto margen de discrecionalidad al juzgador que debe acudir, de manera acusada, a los informes realizados por la policía judicial y peritos que, siendo expertos en la materia, ofrecen luz a la hora de valorar los concretos efectos nocivos de los incendios forestales sobre nuestro medio ambiente y previniendo la proliferación de incendios, especialmente durante la temporada estival.

    The purpose of this research is to carry out a multidisciplinary study on the crime of forest fires at both the legal and operational levels, bringing together and highlighting the actions of the State Security Forces and Corps. As is well known, the burning of forest areas throughout the national territory is a constant and, often, the ways that the State has to combat this illegal behavior are insufficient, causing huge losses and deep damage to our biodiversity. At the same time, the criminal legal response – especially by aggravating the criminal type – seems to be inadequate by leaving a certain margin of discretion to the judge who must resort, in a marked way, to the reports made by the judicial police and experts who, being experts in the field, offer light when assessing the specific harmful effects of forest fires on our environment and preventing the proliferation of fires, especially during the summer season.
