La preocupación y la sensibilidad general sobre el medio ambiente ha sido tenida en cuenta por el constituyente, quien en el artículo 45 de la Constitución Española obliga a legislar para su protección.
Consecuencia del anterior mandato ha sido la inclusión, en la reforma del Código Penal de 1983, del artículo 347 bis en el Capítulo II, Título V, del Libro II del Código Penal.
No obstante, la deficiente redacción dada por el legislador origina serias dudas jurídicas, y casi la inoperatividad del precepto. En este trabajo se examinan cuáles son los motivos, al tiempo que se estudian los elementos del tipo delictivo.

The Legislation has considered the interest and general sensiblity about the environment, as it is seen in the article 45 of the Spanish Constitution. This norm ensures the safety and protection of the environment.
As a consecuence of the previous norm, the article 347 bis in the Chapter II Title V of the Book II of the Criminal Code is included in the new Criminal Code of 1983.
But, because the description given by the legislator was defective, there are serious legal doubts that make the norm almost impossible to fulfill. This survey studies the reason and, at same time, the elements of the kind of offense.
