El presente trabajo analiza una reciente sentencia en la que el Tribunal de Justicia de la Unión Europea se pronuncia sobre un recurso de anulación interpuesto por el Parlamento Europeo (PE) contra el Consejo. Se trata de un asunto cuyo telón de fondo es un reglamento mediante el cual se habían establecido las posibilidades de pesca para determinadas poblaciones y grupos de poblaciones de pesca aplicables en aguas de la Unión Europea (UE) y, en el caso de los buques pesqueros de la Unión, en determinadas aguas no pertenecientes a la UE. Pero, respecto del cual la controversia real no gira en torno a su contenido, sino a la recurrente cuestión del debate interinstitucional entre el PE y el Consejo en relación con el procedimiento legislativo seguido para su adopción.
This paper analyses a recent judgment in which the Court of Justice of the European Union rules on an action for annulment brought by the European Parliament (EP) against the Council. The background to this case is a regulation which had established fishing opportunities for certain fish stocks and groups of fish stocks applicable in European Union (EU) waters and, for EU fishing vessels, in certain non‐EU waters.
However, the real controversy does not revolve around its content, but rather around the recurrent issue of the inter‐institutional debate between the EP and the Council regarding the legislative procedure followed for its adoption.
