El artículo propone que la corrupción puede configurarse como un hecho internacionalmente ilícito desde la responsabilidad internacional del Estado, al ser sus manifestaciones violaciones al derecho internacional de los derechos humanos en sus ámbitos internacional y constitucional, aproximación en la que han avanzado cautamente algunos órganos de supervisión del sistema universal de la ONU. Apoyándose en los avances en la materia desde el control constitucional de tratados y la constitucionalización de la protección internacional de los derechos humanos en distintas jurisdicciones como la colombiana, el artículo dimensiona la lucha contra la corrupción fuera del derecho penal de los Estados y analiza cómo reconfigurar actos de corrupción en hechos que generan la responsabilidad internacional del Estado, identificando la norma violada, víctima, atribución a agentes, daños y reparaciones. Metodológicamente, el artículo utiliza el análisis documental y jurisprudencial.
The article proposes that corruption can be configured as an internationally wrongful act from the international responsibility of the State, since its manifestations are violations of international human rights law in its international and constitutional spheres, an approach in which some supervisory bodies have cautiously advanced in the UN universal system. Relying on recent developments from the constitutional control of treaties in Colombia and the constitutionalization of human rights in different jurisdictions, the article reframes the fight against corruption outside the criminal law of the States and analyzes how to reconfigure acts of corruption into acts that imply the State’s international responsibility, identifying the breached norm, victim, attribution to agents, damages and reparations. Methodologically, the article uses documentary analysis and recent cases.
