Resumen de Hacia un derecho al debido proceso tecnológico

En este trabajo se realiza un análisis de dos fenómenos que están afectando a nuestra justicia, la digitalización y la implementación de herramientas de Inteligencia Artificial, con el objetivo de demostrar la necesidad de un derecho al debido proceso tecnológico. El artículo comienza con una descripción de las tecnologías digitales y con un examen del proceso de implementación de las mismas en la justicia. Tras ello, se proponen tres criterios de clasificación de las herramientas algorítmico-jurídicas que están afectando al proceso, a saber: según su finalidad, según su función y según su diseño tecnológico. En el punto tercero se constatará la falta, hasta el momento, de propuestas para hacer frente a esta realidad por la vía de un nuevo diseño del derecho al debido proceso. Por tanto, se termina con la siguiente conclusión: la urgencia de adaptar el debido proceso a la realidad tecnológica a través del derecho al debido proceso tecnológico.

In this paper, an analysis of two phenomena that are affecting our justice, such as digitalization and the implementation of Artificial Intelligence, is conducted with the aim of proving the need for a right to technological due process of law. The article begins with a description of digital technologies and an examination of its implementation in justice. Then, we propose three ways of classifying the algorithmic-legal tools that are affecting the process, which are the teleological criteria, the functional criterio and the technological design criterio. In sight of the possible effects of these technological developments, we highlight the general absence, so far, of proposals to face the threats through the right to due process of law. We conclude the urgency of adapting due process of law to the technological reality through the technological due process of law.
