Resumen de Positivismo jurídico y la aplicación del Derecho

Este trabajo busca esclarecer la (ya tradicional) crítica que se le hace al positivismo jurídico relacionada con su insuficiencia práctica. En general, no somos capaces de saber con certeza si acaso el iuspositivismo tiene una teoría de la aplicación del Derecho y cuál es esta. Los autores pertenecientes a esta corriente de pensamiento no han desarrollado en profundidad este punto y la bibliografía sobre el tema en específico es escasa. Frente a esta problemática, se busca responder las siguientes preguntas: ¿Es posible una teoría positivista de la aplicación del Derecho? de ser afirmativa la respuesta ¿cuáles serían sus elementos característicos?

This work seeks to clarify the (already traditional) criticism that is made of legal positivism related to its practical insufficiency. In general, we are not able to know with certainty whether iuspositivism has a theory of the application of law and what it would be. The authors belonging to this current of thought have not developed in depth this point and the bibliography on the specific subject is scarce. Faced with this problem, it seeks to answer the following questions: Is a positivist theory of the application of law possible? if the answer is yes: what would be its characteristic elements?
