    En el presente trabajo se ofrecerá una noción teórica del concepto de derechos humanos, otorgando fundamental importancia a cuestiones relativas a la universalidad, en relación con el contexto social contemporáneo de multiculturalismo - fragmentación cultural y globalización. Creemos que los derechos humanos encuentran su fundamento, su razón de ser, en un carácter general y fundante del género humano: la dignidad. Si bien dignidad no es un término unívoco, sino más bien, un término polivalente, intentaremos conceptualizarlo lo más acabadamente posible para erigirlo como garante de la universalidad que pretendemos para los derechos humanos. En una segunda parte del trabajo intentaremos entender el renacer de ciertos discursos que pretenden deslegitimar a los Derechos Humanos tildándolos de "pro-delincuentes". Para ello analizaremos cómo surgen y de dónde vienen estas ideas de denotado talante represivo, y cuáles son sus presupuestos teóricos y fácticos. Para ello repasaremos el nacimiento y ocaso del Estado-Nación Moderno, y su situación actual, para finalizar preguntándonos acerca del rol de los Derechos Humanos en este escenario.

    In this paper we provide a theoretical notion of the concept of human rights, giving primary importance toissues of universality, in relation to the contemporary social context of multiculturalism - cultural fragmentation and globalization. We believe that the concept of human rights has its foundation, its deep rationalization, since a general and founding aspect of mankind: dignity. While dignity is not a univocal term, but rather a polyvalent term, we will attempt to conceptualize it the fully as possible, in order to increase its potential to establish itself as guarantor of universality that we intend to human rights. In a second part of the paper we try to understand the revival of certain discourses that seek to delegitimize the Human Rights, by calling them "pro-criminal." It looks at how they arise and where these ideas come from, with a denoted repressive mood. And what are its theoretical and factual assumptions. To do this we will review the birthand decline of the modern nation-state, and its current situation, to conclude by asking about the role of human rights in this contemporary scenario
