Este ensayo plantea cómo estudiar y fortalecer los ordenamientos jurídicos extraestatales. Primero reafirma laexistencia de estos ordenamientos en Latinoamérica e indaga por qué la academia –generalmente- los invalida.Después sostiene que tal descalificación se debe a que los dichos ordenamientos desafían el dogma jurídico/políticode que el derecho se legitima en la voluntad de los miembros de una sociedad. Por su misma existencia, losordenamientos jurídicos extraestatales son una manifestación de lo que Michael Foucault llamó el discurso del historicismo político que plantea que: el origen de las instituciones de poder –entre estas el derecho- no se encuentra en la referida voluntad sino en las luchas y confrontaciones históricas de poder. En este marco, el ensayo propone el proyecto genealógico de Foucault y el diálogo de saberes planteado por Paulo Freire, como herramientas de estudio con los saberes jurídicos sometidos para fortalecer los ordenamientos jurídicos extra estatales

This essay wonders how to understand and strengthen non-state legal systems. It begins by emphasizing that non-state legal systems do exist in Latin America and explores why, in most cases, they are invalidated by academia.It suggests that this invalidation occurs because non-state legal systems question the juridical-political dogma that affirms that the State’s law rests and is legitimated in the will of society’s members. This essay furthers that non-statelegal systems are a manifestation of what Michel Foucalt called the discourse of political historicism, which claims that the origin of the institutions of power, including the Law, is not found in the aforementioned will, but in history’s confrontations of power. In this framework, this essay proposes Foucalt’s genealogical project and Paulo Freire’s “dialogue of understandings” as tools that can contribute towards the study of submitted knowledge and the strengthening of non-state legal systems.
