Resumen de A instrumentalidade da empresa individual de responsabilidade limitada (EIRELI)

The present study investigates the applicabilities of the single member limited liability company (EIRELI), a legal entity inserted in Brazilian legal order by Law 12,441, of July 11, 2011. Therefore, the past historical context is examined, including the lawmaker's intent. After that, the EIRELI`s functions are characterized, discussing their potentialities in a comparative analysis. From the methodological point of view, this paper is based essentially on bibliographical and documentary research, thereby being eminently theoretical, using the orthodox legal sources, that is, the legislation, specialized doctrine and jurisprudence of the Brazilian courts.

O presente trabalho investiga as aplicabilidades da empresa individual de responsabilidade limitada (EIRELI), pessoa jurídica inserida no direito brasileiro pela Lei 12.441, de 11.07.2011. Nesse sentido, é examinado o contexto histórico pretérito, englobando o instituto do legislador ao editar a norma. Posteriormente, são apresentadas as funções em si desempenhadas pela EIRELI, discorrendo-se sobre suas potencialidades em análise comparativa. Do ponto de vista metodológico, o artigo se funda essencialmente em pesquisa bibliográfica e documental, eminentemente teórica, utilizando-se das fontes jurídicas ortodoxas, isto é, a legislação, a doutrina especializada e a jurisprudência dos tribunais brasileiros.
