Las Reglas de Praga como ayuda para la tramitación eficiente de los procedimientos en el arbitraje internacional

    Se ha generado una discusión, a mi juicio artificial, sobre si las Reglas de Praga y la Reglas de la IBA contienen disposiciones totalmente opuestas, dado que al estar inspiradas en principios de civil law las primeras y de common law las segundas, los resultados que surgen de la aplicación de unas Reglas o de otras son absolutamente irreconciliables. Este artículo trata de demostrar que, a pesar de que las Reglas de Praga contienen ciertas instituciones jurídicas que no son del gusto de los juristas de common law, son muchas las coincidencias en la forma que unas y otras Reglas tienen de abordar el problema de lograr una mayor eficiencia en la tramitación de los procedimientos en el arbitraje internacional.

    There has been a discussion, in my opinion artificial, as to whether the Prague Rules and the IBA Rules contain totally opposite provisions, given that, as the former are inspired by civil law principles and the latter by common law principles, the results that arise from the application of one or the other Rules are absolutely irreconcilable. This article attempts to show that, despite the fact that the Prague Rules contain certain legal institutions that are not to be liked by common law jurists, there are many coincidences in the way in which the two Rules address the problem of achieving greater efficiency in the conduct of proceedings in international arbitration
