    Mining in the Area has for a long time remained a Utopian ideal, with States unready to launch into activity for technical and financial reasons. However, the first exploration contracts, having expired, will soon be replaced by seabed mining contracts. Faced with this possibility, it is interesting to understand the issues underlying this activity. The economic and environmental stakes then clash, leaving the law with the task of reconciling conflicting interests. The International Seabed Authority (ISA) plays a major role in the feasibility of this project, as it administers the Area and its resources and controls exploration and future exploitation. This paper examines the future of mining in the Area by analysing how its legal regime attempts to reconcile two conflicting interests, namely exploitation and protection of the marine environment.

    L’exploitation minière dans la Zone est longtemps restée au stade de l’utopie, les États n’étant pas encore prêts techniquement et financièrement à se lancer dans une telle activité. Cependant, les premiers contrats d’exploration ont expiré et laisseront bientôt leur place aux permis d’exploiter les fonds marins. Face à cette éventualité, il est intéressant de comprendre les enjeux sous-jacents à cette activité. Les enjeux économiques et environnementaux s’affrontent alors, laissant au droit une mission de conciliation entre des intérêts contradictoires. L’Autorité internationale des fonds marins (AIFM) joue un rôle majeur dans la faisabilité de ce projet, puisque c’est elle qui administre la Zone et ses ressources et contrôle l’exploration et la future exploitation. Cet article permet de s’interroger sur l’avenir de l’exploitation minière dans la Zone, en analysant la façon dont son régime juridique tente de concilier deux intérêts a priori antinomiques, à savoir l’exploitation et la protection du milieu marin.
