Las “criptomonedas”, los “tokens”, “criptoactivos” o también llamadas monedas virtuales son la novedad en los últimos años. Para explicar el potencial o quizás, también ciertas limitaciones en cuanto a casos de uso, a continuación, se propondrá la confección de un posible caso de uso. Para ello se indagará en aquello que se conoce como la “tokenización” de activos. La propuesta versará sobre una posible comercialización del derecho de propiedad inmobiliaria mediante tecnología “blockchain”. No obstante, jurídicamente se acudirá tanto a nociones del derecho de obligaciones, derechos reales y registral, con el fin de proponer una adaptación adecuada y completa para el caso de uso. Pero el análisis jurídico no finaliza en los puntos anteriores, sino que, para dotar de mayor robustez al caso de uso, se acudirá al contrato de “escrow” y a la identidad digital.

Cryptocurrencies, tokens, crypto assets or also called virtual currencies are the novelty in recent years. To explain the potential or perhaps also certain limitations in terms of use cases, next, the construction of a possible use case will be proposed. For this, what is known as the tokenization of assets will be investigated. The proposal will deal with a possible commercialization of real estate property rights through blockchain technology. However, legally, both notions of the right of obligations, real rights and registration will be used, in order to propose an adequate and complete adaptation for the case of use. But the legal analysis does not end in the previous points, but rather, to provide greater robustness to the use case, the escrow contract and the digital identity will be used.
