O presente artigo discute a relação entre o instituto da imunidade parlamentar e o direito fundamental à liberdade de expressão a partir da interpretação sistemática dos princípios da Constituição brasileira de 1988. A principal hipótese do trabalho é a de que a imunidade parlamentar no Brasil não abarca o chamado discurso de ódio, que configura manifestação ilegítima do pensamento de acordo com a Constituição brasileira. A recente jurisprudência do Supremo Tribunal Federal confirma essa hipótese ao consagrar que a imunidade parlamentar não é um instituto de natureza absoluta, sujeitando-se à ponderação com o princípio da dignidade humana.

The present article discusses the relationship between the institute of parliamentary immunity and the fundamental right of freedom of speech from a systematic interpretation of the principles laid down in the Brazilian Constitution of 1988. The main hypothesis of the work is that in Brazil the parliamentary immunity does not include the so-called hate speech, which configures an unlawful manifestation of thought according to the Brazilian Constitution. The recent jurisprudence of the Brazilian Supreme Federal Court confirms this hypothesis in providing that the nature of the parliamentary immunity is not absolute and consequently it can be weighed against the principle of human dignity.
