Resumen de Consideraciones en torno a la efectividad de determinados derechos de las personas con discapacidad intelectual

En este trabajo de investigación se realiza un análisis jurídico sobre la efectividad de ciertos derechos de las personas con discapacidad intelectual.
La finalidad perseguida es la de verificar si las actuales normativas y políticas públicas garantizan dichos derechos y abordan con perspectiva inclusiva los problemas que enfrentan estas personas en virtud de sus deficiencias psíquicas, la estigmatización aún presente en la sociedad sobre la discapacidad y la consecuente inadaptabilidad del entorno.
Además, este estudio pretende indagar en los problemas raíces de la inefectividad de sus derechos, así como analizar los procedimientos a seguir por parte de los operadores jurídicos y profesionales de los distintos ámbitos cuando el usuario es una persona con discapacidad intelectual.
Se analizan: el derecho a la educación inclusiva, el derecho a la asistencia sanitaria, el derecho de sufragio activo y pasivo y el derecho a la tutela judicial efectiva.

In this research work, a legal analysis of the effectiveness of certain rights of persons with intellectual disabilities is carried out.
The purpose is to verify if the current public policies and regulations guarantee these rights and approach with an inclusive perspective the problems these people face in virtue of their mental deficiencies, the stigmatisation of disability still present in society and the consequent unsuitability of the environment.
In addition, this study aims to investigate the root problems of the ineffectiveness of their rights, as well as to analyse the proceedings to be followed by legal operators and professionals in the different fields when the user is a person with intellectual disabilities.
It analyses: the right to inclusive education, the right to health care, the right to vote and stand as candidates and the right to effective legal protection
