Estudio comparativo de la función notarial romana con la actual

    Este trabajo pretende realizar una comparación entre la figura del tabellio romano con la del notario actual para descubrir los muchos puntos en común de estas dos instituciones, reconocidas ambas por la sociedad como verdaderos profesionales del Derecho. Un buen jurista es aquel que conoce la palabra ius que proviene de iustitia siendo esta el “arte de lo bueno y de lo justo”. Es un sacerdote, un guardián de la legalidad ya que rinde culto a la justicia y profesa “el saber de lo bueno y de lo justo, separando lo justo de lo injusto, discerniendo lo lícito de lo ilícito, anhelando hacer buenos a los hombres, no sólo por el temor de los castigos, sino también por el estímulo de los premios, dedicado, si no yerro, a una verdadera y no simulada filosofía” (Ulpiano. D. 1, 1, 1).

    Así, la figura del notario que hoy conocemos realiza una indispensable función pública en el ámbito del estado patrimonial de personas físicas y jurídicas. Además, es quizá uno de los juristas mejor preparados de la actualidad. Estas características son las que previenen de su posible sustitución por el uso de nuevas tecnologías como los blockchain, ¿podrá adaptarse a la nueva realidad que deparan las nuevas tecnologías? Aparentemente sí, pero sólo el transcurso del tiempo dirá.

    The aim of this paper is to compare the figure of the Roman tabellio with that of the current notary, in order to spot the many points in common between these two institutions, both of which are recognised by society as true legal professionals. A good jurist is one who knows the word ius, which comes from iustitia, iustitia being the "art of what is good and just". He is a priest, a guardian of legality, for he cultivates justice and professes “the knowledge of the good and the just, separating the just from the unjust, discerning the lawful from the unlawful, longing to make men good, not only by the fear of punishments, but also by the encouragement of rewards, devoted, if I do not err, to a true and not a pretended philosophy”(Ulpianus. D.1.1.1).

    Thus, the figure of the notary as we know it nowadays performs an indispensable public function in the area of the property status of natural and legal persons. In addition, it is perhaps one of the best trained jurists of our present. These characteristics are the ones that prevent its possible replacement by the use of new technologies such as blockchain. Will it be able to adapt to the new reality that new technologies bring? Apparently so, but only time will tell
