Resumen de Violência doméstica contra a mulher, convivência familiar e alegações de alienação parental

  This is an introductory contribution to the literature on the “right to family life” for children and adolescents in contexts of domestic violence and on allegations of parental alienation. Based on their professional experience in the forensic arena, the authors identify the occurrence of allegations of parental alienation against women protected by restraining orders issued under the Maria da Penha Law. Based on national and international bibliographic research, the authors dialogue with the literature on domestic violence, parental alienation, and family life, making considerations on the issue of “children's best interest”, widely used in the legal system. It concludes that there have been legal and regulatory advances in the protection of the rights of the most vulnerable groups; however, the remnants of a patriarchal order are also present and reproduce gender disparities within the legal system.

  Trata-se de contribuição introdutória sobre o direito à convivência familiar de crianças e adolescentes em contextos de violência doméstica e alegação de alienação parental. A partir da experiência profissional na área sociojurídica identifica-se a ocorrência de acusações de alienação parental contra mulheres amparadas por medidas protetivas da Lei Maria da Penha. Com base em pesquisa bibliográfica nacional e internacional, as autoras dialogam com produções críticas sobre violência doméstica, alienação parental e convivência familiar, tecendo considerações sobre o princípio do “melhor interesse” da criança, amplamente utilizado no judiciário. Conclui-se que há avanços normativos na proteção dos direitos de segmentos mais vulneráveis, contudo, os resquícios de uma ordem patriarcal também se fazem presentes e reproduzem as disparidades de gênero no sistema de justiça.
