Resumen de O ius commune latino-americano e o direito brasileiro: Uma estratégia para superação das permanências autoritárias e democratização do processo penal

This work identifies a close link between criminal procedure and democracy, because it is never indifferent or static in relation to the political regime, which also justifies studying it under a constitutional approach. However, even after the democratic Constitution of 1988, Brazil persists in suffering from authoritarian permanencies. From this perspective, this study is concerned with overcoming this authoritarianis which is part of a broader context, the Latin American one. The countries in this region have a common past - exploitative colonialism, human enslavement and violent civil-military dictatorships - which has not been overcome, despite all having theoretical tools and formal institutions o do so. The need to consolidate democracy and making guarantees effective requires evaluating proposals capable of interfering with the authoritarian reality of the Brazilian criminal procedure in order to change it, adapting it to the democratic environment. Therefore, the theoretical project recommendations of the Latin American Ius Commune are investigated herein, which, aware of the weakness of institutions on the Continent, seeks to develop democracy, the rule of law and human rights through constitutionalism which interrelates internal rights and guarantees with the international ones of the Inter-American System of Human Rights.

Este trabalho identifica um vínculo estreito entre processo penal e democracia, porque ele nunca é indiferente ou estático em relação ao regime político, o que justifica estudá-lo também sob enfoque constitucional. Porém, mesmo após a Constituição democrática de 1988, o Brasil persiste a sofrer com permanências autoritárias. Nessa ótica, a pesquisa se preocupa em superar esse autoritarismo, o qual se insere em uma conjuntura mais ampla, a latino-americana. Os países dessa região têm um passado em comum - colonialismo de exploração, escravidão de seres humanos e ditaduras civis-militares violentas – o qual não foi superado, apesar de todos contarem com ferramentas teóricas e instituições formais para tanto. A necessidade de sedimentar a democracia, efetivando garantias, impõe sejam avaliadas propostas capazes de interferir na realidade autoritária do processo penal brasileiro para alterá-la, adequando-lhe ao ambiente democrático. Por isso, investiga-se as recomendações do projeto teórico do Ius Commune Latino-americano, o qual, ciente da debilidade das instituições no Continente, busca desenvolver ademocracia, o Estado de Direito e os direitos humanos, por meio de um constitucionalismoque interage direitos e garantias internas com as internacionais do SistemaInteramericando de Diretos Humanos.
