  La presente investigación se planteó como objetivo general analizar jurídicamente el abuso del derecho de la acción de protección. Se apoyó en la metodología cuantitativa la cual produce datos descriptivos, que se originan por la recolección de datos. Desde el apoyo documental-bibliográfico. Además, se aplicó el método inductivo-deductivo, el cual sugiere que para encontrar una verdad se deben buscar los hechos y no basarse en meras especulaciones. Se planteó además el método analítico-sintético por medio del cual, se descompone un todo en partes. La utilización de estos métodos hizo posible que se analicen doctrinas, cuerpos normativos, documentos jurídicos, bibliografía, la cual, permitió que se generen criterios y aportes. Se concluye que, la mayoría de acciones de protección presentadas en la Unidad Judicial con sede en el cantón El Carmen, durante el año 2021, fueron declaradas sin lugar por no haber concurrido los requisitos indispensables establecidos en la Ley de Garantías.

  The general objective of this research was to legally analyze the abuse of the right of protection action. It was supported by the quantitative methodology which produces descriptive data, originating from data collection. From the documentary-bibliographic support. In addition, the inductive-deductive method was applied, which suggests that in order to find the truth, facts must be sought and not based on mere speculation. The analytical-synthetic method was also used, by means of which a whole is broken down into parts. The use of these methods made it possible to analyze doctrines, normative bodies, legal documents, bibliography, which allowed the generation of criteria and contributions. It is concluded that most of the protection actions filed in the Judicial Unit based in the canton of El Carmen, during the year 2021, were declared unfounded for not having met the essential requirements established in the Law of Guarantees.
