El objetivo general de la investigación fue analizar jurídicamente la vulneración al derecho de seguridad jurídica desde el derecho a la resistencia. El presente trabajo es de tipo descriptivo, con enfoque cuantitativo, de campo no experimental, cuya estrategia metodológica fue sistematizada mediante el análisis sintético con el cual es posible realizar un examen de la situación actual, apoyada en la revisión y análisis documental de las diferentes leyes y normas en jurídica, tesis y trabajos arbitrado, se aplicó una encuesta constituida por cuatro interrogantes a un grupo de 95 abogados en libre ejercicio inscritos en el foro de abogados de la provincia de Tungurahua, cuyos resultados contribuyeron a establecer las conclusiones sobre la problemática estudiada. Concluyendo, este derecho evidencia algunas contrariedades, debido a que no existe la vía procedimental para hacer valer la resistencia, suele ser considerado por la administración de justicia como un acto de irrespeto a la ley.

The general objective of the research was to legally analyze the violation of the right to legal security from the right to resistance. The present work is descriptive, with quantitative approach, non-experimental field, whose methodological strategy was systematized through the synthetic analysis with which it is possible to make an examination of the current situation, supported by the review and documentary analysis of the different laws and regulations in legal, thesis and refereed works, a survey consisting of four questions was applied to a group of 95 lawyers in free practice registered in the forum of lawyers of the province of Tungurahua, whose results contributed to establish the conclusions on the problems studied. In conclusion, this right evidences some contradictions, due to the fact that there is no procedural way to enforce the resistance, it is usually considered by the administration of justice as an act of disrespect to the law.
