Resumen de La aplicación de la justicia indígena vulnera o no los derechos humanos

  El objetivo general de la investigación fue analizar jurídicamente la aplicación de la justicia indígena vulnera o no los derechos humanos. Desde el paradigma cuantitativo, se trabajó con una metodología de tipo descriptiva documental con un diseño bibliográfico, permitiendo indagar en fuentes bibliográficas y jurídicas, articulando un cuerpo reflexivo teórico como contribución al fortalecimiento del basamento teórico-jurídico del derecho. Generándose un proceso analítico–reflexivo, contribuyendo a la generación de la extensión teórica. La utilización de estos métodos hizo posible que se analice doctrina, cuerpos normativos, documentos jurídicos, la cual luego del análisis pertinente, permitió que se generen criterios y aportes. Se concluye que, el derecho indígena no vulnera los derechos humanos, ya que este no priva la libertad al ser humano, sino caso contrario lo rehabilita y le permite de tal modo su reinserción con la comunidad, ya que de tal manera se aplica los conocimientos ancestrales, costumbres y tradiciones.

  The general objective of the research was to legally analyze whether or not the application of indigenous justice violates human rights. From the quantitative paradigm, we worked with a documentary descriptive methodology with a bibliographic design, allowing to investigate in bibliographic and legal sources, articulating a theoretical reflective body as a contribution to the strengthening of the legal-theoretical basis of law. Generating an analytical-reflexive process, contributing to the generation of theoretical extension. The use of these methods made it possible to analyze doctrine, normative bodies, legal documents, which after the pertinent analysis, allowed the generation of criteria and contributions. It is concluded that indigenous law does not violate human rights, since it does not deprive human beings of their freedom, but rather rehabilitates them and allows them to reintegrate into the community, since ancestral knowledge, customs and traditions are applied in this way.
