    La investigación comprende el estudio del delito continuado en sistemas jurídicos donde la figura ha estado operando por vía de la jurisprudencia y bajo el amparo de norma legal. En tales casos se estudian los sistemas jurídicos de España y Alemania, no solo por sus aportes a la ciencia del derecho y al delito continuado, en particular, sino también porque representa las dos vertientes del problema, para lo cual se toma los pronunciamientos vertidos por los órganos judiciales de mayor jerarquía y las opiniones de la doctrina científica, a fin de realizar un análisis crítico sobre la aplicación de la figura en estas fuentes del Derecho, lo que cuestiona y propone este artículo.

    The investigation includes the study of the crime continued in legal systems where the figure has been operating through jurisprudence and under the protection of a legal norm. In such cases the legal systems of Spain and Germany are studied, not only for their contributions to the science of law and continued crime, in particular, but also because it represents the two aspects of the problem, for which the pronouncements expressed by the judicial organs of greater hierarchy and the opinions of the scientific doctrine, in order to carry out a critical analysis on the application of the figure in these sources of the Law, which questions and proposes this article.
