Resumen de El derecho a la rebelión, el derecho a la resistencia ¿Son derechos humanos?

  El  objetivo principal del presente artículo es determinar sí  la rebelión y la resistencia son derechos humanos, para lo cual se abordó aspecto doctrinario y legal para entender si la acción de rebelarse, sublevarse o insurgir ante políticas de gobernantes tiranos y opresores, tienen la protección de instrumentos internacionales de derechos humanos. La metodología utilizada fue el método de análisis y síntesis en diferentes documentos y normativas internas y externas. Los resultados evidencian un esquema de protección y garantista hacía la acción de los hombres de reaccionar cuando se está frente a un poder atentatorio a los derechos fundamentales. Se concluye indicando que si bien la Constitución del Ecuador, establece el derecho a la resistencia, sin embargo, mantiene como delito penal la rebelión, además, existe una responsabilidad estatal para garantizar estos derechos, el de la resistencia y de la rebelión que además son protegidos por instrumentos internacionales de derechos humanos.

  The main objective of this article is to determine whether rebellion and resistance are human rights, for which a doctrinal and legal aspect was approached to understand if the action of rebelling, rebellion or insurgency before the policies of tyrant rulers and oppressors, have the protection of international human rights instruments. The methodology used was the method of analysis and synthesis in different internal and external documents and regulations. The results show a protection and guarantee scheme for the action of men to react when faced with a power that violates fundamental rights. It is concluded by indicating that although the Constitution of Ecuador establishes the right to resistance, however, it maintains the rebellion as a criminal offense, in addition, there is a state responsibility to guarantee these rights, that of resistance and rebellion, which are also protected by international human rights instruments.
