  • Resumen
    • The essay deals with the theme of the so-called “assisted suicide” given to a person, who is fully capable of making free and informed decisions, kept alive by life-saving treatments and suffering from an irreversible disease, a source of physical or psychological suffering considered intolerable, as demonstrated by the sentence of the Italian Constitutional Court no. 242/2019. It’s pointed out that the practice of assisting suicide, within very narrow limits, could be justified in the light of the constitutional protection of human dignity (cf.

the ECHR’s orientation on the matter); it’s also highlighted the irreducibility to “therapeutic self-determination” in the event that it gives individuals the right to refuse the care necessary for their health or to request the interruption of health treatments on which their survival depends.
