The principle of effective judicial protection was drawn by the Court of Justice from a fundamental right enshrined in the common constitutional principles of Member States and now protected by Article 47 of the EU Charter of Fundamental Rights. The present work aims to anlyse the consistency of the principle with particular reference to its impact - after the codification in Article 19 TEU and 47 of the Charter, operated by the Lisbon Treaty - on national law, that is evident in the recent case law of the Court of Justice.
