Resumen de Análisis de los parámetros de la motivación judicial en el Ecuador

  Se muestra un enfoque del desarrollo jurisprudencial de los parámetros que configuran a la motivación judicial en el Ecuador, la razonabilidad, la lógica y la comprensibilidad. Se pretende recopilar y describir los criterios que ha tenido la Corte Constitucional en torno a esta garantía del debido proceso y como determinadas sentencias aportan con un progreso determinante a dichos parámetros. Para lo expresado, se realiza una investigación cualitativa basada en los métodos histórico - lógico analítico-sintético e inductivo-deductivo. Se concluye que es indispensable que los jueces funden sus resoluciones en cualquiera de las fuentes del derecho, que estas tienen que ser aplicables al caso, que debe existir coherencia entre las premisas y la conclusión y esta última con la decisión de una resolución y por último que todo ello debe redactarse de forma clara, comprensible que permita al ciudadano en general comprender la resolución y formar parte de su fiscalización.

  An approach to jurisprudential development of the parameters that shape judicial motivation in Ecuador, reasonableness, logic and understandability is shown. It is intended to compile and describe the criteria that the Constitutional Court has had regarding this guarantee of due process and how certain judgments contribute with decisive progress to these parameters. For the above, qualitative research is carried out based on the historical - logical analytical-synthetic and inductive-deductive methods. It is concluded that it is essential that the judges merge their resolutions in any of the sources of law, that these must be applicable to the case, that there must be consistency between the premises and the conclusion and the latter with the decision of a resolution and finally that all this must be written in a clear, understandable way that allows the citizen in general to understand the resolution and be part of its inspection.
