Resumen de Per i migranti ambientali: non muri o respingimenti ma solidarietà e accoglienza
The condition of environmental migrants can be examined essentially from two points of view, one external and internal one to the state system. The first point of view concerns the protection recognized to environmental migrants by the international community and in the European Union legal system. For the second one, instead, the Italian Constitution represents a fundamental reference.
The article analyzes the environmental migrants’ condition according to legal systems above.
The lack of a specific protection for environmental migrants, both at international and domestic constitutional level, must be overcome.
For that purpose, a specific legislation is deemed necessary, although while waiting for legislative interventions at the international and constitutional level, the respect of constitutional values with regards to environmental migrants is considered fundamental.
