  Any claim rulership made by a central power is supported by the legitimacy granted to the accomplishment of important tasks that benefit the whole society. One of the most obvious is the maintenance of public order, security and discipline. During the «vintista» conjuncture (1820/1823) both the shifting of parallel power to the public sector and the progressive juridical regulation, expropriate the punitive capacity of the organs and institutions of the «Ancien Regime», and divulge new disciplinary models which alter the relationship between citizen and political power. At the same time the notion of crime and punishement changes. Though still in an exploring manner, the purpose of the present text is to call our attention to the political importance of these question and the social characterization of criminal practice. We have on one side the action of gangs which seem to appoint themselves the resistance forts to the Liberal State by right, and on the other, the crime groups which give traditional answers when faced with conditions of poverty and unemployment.

  Les prétentions dans la domination d 'un pouvoir central vivent de la legitimité qui lui donnent la réalisationd'irnportantes tâches pour toute la société. Une, des plus grandiose" c'est la manutention de I'ordre, de la sécurité et de la discipline, Pendant la conjoncture vintista (1820/1823) I'étatisation des pouvoirs paralleles et la progressive régulamentation juridique, exproprient la capacité de punir des organismes et des institutions de l'Ancien Regime ainsi comrne interprétent les nouveaux modeles disciplinaires qui modifient la rélation entre le pouvoir politique et le citoyen. On change concomitantement les notions entre Ie crime et Ie chatirnent. On prétend avec Ie présent texte, encore d'une maniere tres explorateuse attirer I'attention pour I'irnportance politique de ces questions et la caractérisation sociale de la prócedure criminelle. D'un côté l'action des quadrilles qui semblent sorganiser en redoutes de résistance à I 'État libérale de droit et, d'un autre à des groupes criminels qui appliquent des réponses traditionnelles face à la situation de misere et de chômage.
