  • The aim of this paper is to analyse the impact of the intergovernmental method on the decision-making of the Union concerning the Common European Asylum System (CEAS) in the light of the recent migration crisis. To this end, it firstly examines – in brief – the most important primary and secondary rules of EU law on the matter. Secondly, it investigates both the reasons behind the crisis, as well as those behind the diverging positions that the Member States have taken on this issue. This would allow: i) to understand if, and to what extent, the crisis has produced the effect of marginalising the supranational method in favour of the intergovernmental one: ii) to identify, with reference to the asylum policy, the limits of the latter, and iii) to attempt to draw up a model concerning the use of these different decision-making methods within the ambit of the reform of the CEAS.
