    A partir de los años 90 en Sudamérica se experimentan cambios en las escrituras constitucionales, este proceso ha venido a llamarse por algunos doctrinados nuevo constitucionalismo latinoamericano, categoría en la cual entre otras cuestiones se extiende el catálogo de derechos, llegando incluso algunos, como la Constitución Política del Estado boliviano a alcanzar y gozar de las garantías y acciones de los derechos fundamentales, todos los derechos establecidos en la propia constitución y los tratados internacionales. En este sentido cabe preguntarse si a partir de la vigencia de este texto normativo fundamental se ha conseguido llevar a la práctica lo diseñado por la Asamblea Constituyente y cuáles son los niveles de protección efectiva de los derechos humanos. Para ello se ha delimitado el análisis de manera especial el territorio del Estado Plurinacional de Bolivia.

    From the 90's in South America have been experiencedchanges in constitutional scriptures, this process has come to be calleda new Latin American constitutionalism. The category in which the catalog of rights extendsto the Political Constitution of the State of Bolivia among others, which reaches benefits from the guarantees and actions of the fundamental rights, and all rights established in the Constitution and international treaties. Inthis regard, it ¡s questionable whetherfrom the validity of this fundamental normative text, the practical context has been achieved and implement as designed by the Constituent Assembly,and what are the levels of effective protection of human rights. For this purpose, the analysis has been identified particularly to the territory of the Plurinational State of Bolivia.
