This article analyzes the failed adoption by the Security Council of the Referral to the International Criminal Court on May 2014. The article moves from an examination of the Syrian crisis, highlighting the impasse within the Security Council in facing such a tragedy. In this context, the failed referral is another attempt of crisis management that the SC has not concluded. Thus, moving from an analysis of the political dynamics of the Syrian Crisis management, the author focuses on the referral and on its main legal contradictions.
