    A través de la presente investigación, se pretendió establecer la posición que tiene la Sala Civil de la Corte Suprema de Justicia frente a la potestad que tiene el juez de decretar pruebas de oficio, para lo cual se utilizó como método la revisión de las sentencias proferidas por esta Corporación durante los años 2005 a 2010. Obtenido el material relevante, se procedió al análisis estructural de los pronunciamientos que aludieron al tema, siguiendo el protocolo establecido por la Escuela Judicial Rodrigo Lara Bonilla.

    Through the present investigation, it was intended to establish the position of the Civil Chamber of the Supreme Court of Justice regarding the power that the judge has to decree ex officio evidence, for which the review of the sentences handed down was used as a method. by this Corporation during the years 2005 to 2010. Once the relevant material was obtained, we proceeded to the structural analysis of the pronouncements that alluded to the subject, following the protocol established by the Rodrigo Lara Bonilla Judicial School.
