En este trabajo se analizan las tensiones que suscitó el reconocimiento del Ju-rado en el status quo de la Justicia en los albores del Estado constitucional en España. En concreto, se analiza el papel desempeñado por las Cortes, a las que se encomendó su establecimiento, y la Justicia togada en la errática implantación de este Tribunal. Advertir las dificultades que surgieron en la puesta en funcionamiento de la Institución en este periodo, resulta fundamental para entender en buena medida su posterior evolución.
This paper analyses the tensions that the recognition of the Jury raised in the status quo of Justice at the dawn of the constitutional State in Spain. Specifically, it analyses the role played by the Parliament, which was entrusted with its creation, and the judiciary in the erratic implementation of this Tribunal. It is essential to note the dificulties that arose in setting up the institution during this period in order to understand to a large extent its subsequent evolution.
