    En este artículo, su autor analiza la rescindibilidad de las operaciones derivadas de financiación con ICO que traen su causa de los Reales Decretos-leyes 8/2020 y 25/2020. El análisis se realiza tanto desde una perspectiva procesal como de carácter sustantiva, y se apunta también a otros mecanismos de impugnación (acciones de nulidad y rescisorias frente a acreedores por fraude). No obstante, dada la longitud del artículo, lo fragmentamos y, en este número, ofrecemos la primera parte, enfocada al planteamiento del análisis. La segunda parte, relativa a la rescisión concursal, sus efectos y las otras posibles acciones, se incluirá en el número 21 de la LEY Insolvencia, que se publicará en Septiembre próximo.

    In this paper, the author analyzes the possibility of termination, in case of insolvency proceeding, of the COVID-19 guaranteed loans managed by ICO, ruled in the Spanish RDL 8/2020 and 25/2020. The analysis is carried out both from a procedural and substantive perspective, and also points out other legal remedy systems (invalidity actions and rescission by means of an action against creditors in case of fraud). However, given the length of the article, it has been fragmented so, in this issue, the first part is available, focused on the approach of the analysis. The second part, related to the termination of the agreement or contract in the legal framework of an insolvency proceeding, its effects and other possible actions, will be included in issue 21 of the LA LEY Insolvencia, which will be published next September.
