Resumen de Análisis jurídico del ciberacoso como nuevo tipo penal

  La presente investigación se circunscribe en torno alproblema del ciberacoso y sus incidencias relacionadas con la falta de tipicidad. En este sentido el objetivo del presente trabajo consiste en considerar mediante un análisis jurídico la necesidad de crear un nuevo tipo penal que regule el ciberacoso. Para ello fue necesario emplear una modalidad mixta mediante un diseño no experimental transversal con uso de los métodos jurídicos más importantes. Se llegó a la conclusión que resulta altamente necesariointegrar como nuevo tipo penal el ciberacoso, sin distinción de edad y género, en razón de los derechos y principios constitucionales en favor de la no discriminación y al cuidado de su protección integral

  The present investigation is circumscribed around the problem of cyberbullying and its incidents related to the lack of typicity. In this sense the objective of this work is to consider through a legal analysis the need to create a new criminal type that regulates cyberbullying. For this, it was necessary to use a mixed modality through a transversal non-experimental design with the use of the most important legal methods. It was concluded that it is highly necessary to integrate cyberbullying as a new criminal type, without distinction of age and gender, due to constitutional rights and principles in favor of non-discrimination and care for its comprehensive protection
