    Based on national and foreign references, this research has, as its main object, the goal to study how the evolutive interpretation technique is being used by the Inter-American System of Human Rights. The aim was to demonstrate, firstly, that human rights, due to their special nature, do allow a dynamic interpretation in order to achieve their implementation. Afterwards, it was sought to analyze how this technique has been used in the interpretation of the American Convention on Human Rights and its importance for the construction of the inter-American corpus iuris. Finally, in order to demonstrate how this hermeneutic activity takes place, the study analyzes some of the cases judged by the Inter-American Court of Human Rights in which the evolutionary interpretation was used.

    Com base em referenciais nacionais e estrangeiros, a presente investigação, tem como objetivo precípuo analisar a utilização da técnica da interpretação evolutiva no âmbito do Sistema Interamericano de Direitos Humanos. Almejou-se demonstrar, primeiramente, que os instrumentos de direitos humanos, dada a sua natureza especial, permitem uma interpretação dinâmica, a fim de alcançar a sua concretização. Após, buscou-se analisar como essa técnica vem sendo utilizada na interpretação da Convenção Americana de Direitos Humanos e a sua importância para a construção do corpus iuris interamericano. Por fim, a fim de demonstrar como se dá essa atividade hermenêutica, analisou-se alguns dos casos julgados pela Corte Interamericana de Direitos Humanos em que a interpretação evolutiva foi utilizada.
