Identidad de género, identificación y prueba. Algunas reflexiones a propósito del caso sup-jdc-304/2018 y acumulados

    La cuestión relativa a la identidad de género, en especial en aquellos casos en que difiere del sexo asignado al nacer, ha supuesto importantes debates en distintos campos. Uno de ellos es precisamente el del proceso judicial. Este texto tiene por objeto analizar el criterio adoptado por la Sala Superior del Tribunal Electoral de Poder Judicial de la Federación de limitar el objetivo de búsqueda de la verdad, en aras de proteger un conjunto de derechos fundamentales, cuando el objeto de la controversia gira en torno a la identidad de género de una persona. Al respecto, sostendré que no está justificado el sacrificio de tal objetivo, a menos a la luz de las consideraciones del tribunal. Asimismo, defenederé que, incluso admitiendo que lo está, dicho criterio enfrenta importantes problemas en materia de prueba que hacen dudar sobre la pertinencia de las reglas probatorias impuestas por el tribunal para ese tipo de casos

    Gender identity, especially in cases where it differs from the sex assigned at birth, has led to important debates in different fields. One of them is precisely that of the judicial process. This text aims to analyze the criterion adopted by the Superior Chamber of the Electoral Tribunal of the Federal Judiciary to limit the objective of seeking the truth to protect a set of fundamental rights in those cases in which gender identity is questioned. In this regard, I will maintain that the sacrifice of such an objective is not justified, unless in light of the court’s considerations. Likewise, I will defend that, even admitting that it is, said criterion faces significant problems in terms of evidence that cast doubt on the relevance of the evidentiary rules imposed by the court for this type of dispute
