Resumen de Votantes ou eleitores? Os impasses na construção da participação política local no início do oitocentos (1827-1828)

Nas primeiras décadas do Oitocentos iniciou-se no Brasil a edificação dos princípios norteadores das formas de participação popular no Judiciário, dentre as quais se destaca o Juiz de Paz. A Carta Constitucional de 1824 assegurou as garantias básicas desse instituto e estabeleceu sua condição eletiva, contudo a regularização das suas funções e do processo eleitoral foi delegada à Assembleia Nacional. Nesta comunicação objetivou-se abordar a discussão parlamentar que definiu o formato da eleição da magistratura da paz e elucidar as problemáticas enfrentadas pelos políticos brasileiros no momento de decidir quais os cidadãos aptos a participar do pleito municipal. O estudo dos debates empreendidos na Câmara dos Deputados e no Senado nos anos de 1827 e 1828 permitiu investigar como se delineou a opção política dos dirigentes pela eleição primária do representante judiciário local. O exame da discussão almeja contribuir para a compreensão das ideias norteadoras dessa magistratura e dos aspectos relacionados aos direitos políticos do Estado em construção.

In the first decades of the Nineteenth Century in Brazil began the construction of the guiding principles of the forms of popular participation in the Judiciary, among which stands the Justice of the Peace. The Constitutional Charter of1824 ensured the basic guarantees that institute and established their condition elective, however the regularization of their duties and the electoral process has been delegated to the National Assembly. In this communication aimed to address the parliamentary debate that defined the format of the election of justice of the peace and elucidate the problems faced by Brazilian politicians when deciding which citizens are able to participate in municipal elections. The study of the discussions made in National Assembly in the years 1827 and 1828 as outlined possible to investigate the option of political leaders by the primary election of the local judiciary. The examination of the discussion aims to contribute to the understanding of the guiding ideas of the justice of the peace and political rights aspects of the state in construction.
