En el caso de Tabasco, desde 1997 se encuentra previsto en el Código Civil la posibilidad de acudir al uso de la gestación por sustitución. En el presente artículo, se analiza el interés superior de la niñez en el caso de la filiación de los niños nacidos bajo el uso de esta técnica de reproducción asistida, toda vez que a pesar del trabajo realizado por los operadores jurídicos en México sobre el tema, aún quedan vacíos legales que hagan efectivos derechos fundamentales como la identidad. Se persigue proponer un mecanismo que garantice la protección del interés superior de la niñez en casos de gestación por sustitución para la determinación de su filiación que hagan posible el disfrute de derechos fundamentales como la identidad, respetando el margen de apreciación que tienen los Estados para legislar sobre el tema.

In the case of Tabasco, since 1997 the Civil Code has provided for the possibility of resorting to the use of surrogacy.
In this article, the best interest of children is analyzed in the case of filiation of children born under the use of this assisted reproduction technique, since despite the work carried out by legal operators in Mexico on the subject , there are still legal gaps that make fundamental rights such as identity effective. The aim is to propose a mechanism that guarantees the protection of the best interests of the child in cases of surrogacy for the determination of their affiliation that make it possible to enjoy fundamental rights such as identity, respecting the margin of appreciation that States have to legislate. about the topic.
