Resumen de José Victorino Lastarria: filósofo de la historia y tratadista de derecho con perspectiva histórica

Este artículo explora diversos aspectos de la producción intelectual de José Victorino Lastarria, especialmente el uso que hace de la historia en sus obras histórico-jurídicas y de Derecho público, mediante el análisis de los principales libros de Derecho de su autoría. Así se llega a la conclusión que sus obras jurídicas recurren a la historia de manera ponderada y objetiva, en el marco de un método que incluía la filosofía del Derecho, las ciencias políticas y el Derecho positivo. En base a ese análisis, se concluye que el gran aporte de Lastarria es interpretar el Derecho constitucional chileno de su época acorde al liberalismo decimonónico, dándole un nuevo contenido a las normas constitucionales en ese momento vigentes.

This article explores various aspects of José Victorino Lastarria`s intellectual output, especially the use he makes of history in his historical-legal and public la w works, by analyzing the main law books he wrote. It ist thus concluded that his legal works made use of history in a balanced and objective way, within the framework of a method that included the philosophy of law, political science and positive law. Based on this análisis, it is concluded that Lastarria`s great contribution was to interpret the chilean constitutional law of his time in accordance with nineteen-century liberalism, giving a new content to the constitutional norms in force at that time.
