Resumen de Acceso a la justicia y defensa jurídica para mujeres indígenas en la jurisprudencia de la Corte Interamericana de Derechos Humanos

El derecho a la defensa jurídica forma parte del derecho al acceso a la justicia, es un componente esencial para la obtención misma de la justicia y lograr la confianza pública en el sistema jurídico. Este derecho fundamental se ha ido configurando de manera progresiva en la legislación internacional y en el sistema de protección de los derechos humanos. Inicialmente contenido en la Declaración Universal de los Derechos Humanos ha sido objeto de desarrollo normativo y jurisprudencial, especialmente para garantizar el ejercicio de los derechos personas y grupos que suelen ser objeto de mayor discriminación. Entre estos grupos, se analizará de manera especial la situación de las mujeres y específicamente a las mujeres indígenas, que suelen enfrentar mayores obstáculos para acceder, tanto a la justicia oficial como a la justicia propia, cobrando mayor sentido la existencia de una defensa especializada.

The right to legal defense is part of the right to access to justice. It is an essential part for obtaining justice and obtaining public confidence in the legal system. This fundamental right has been gradually configured in international legislation and in the Human Rights system protection. Initially contained in the Universal Declaration of Human Rights, it has been subject to normative and jurisprudential development, especially to guarantee the exercise of the rights of individuals and groups that are usually subject to greater discrimination and violation of rights. Among these groups, this article will analyze the situación of women and more specifically indigenous women, who usually face greater obstacles of access justice as much in the formal justice system as in theirs. This reality makes it legitimate to advocate for a specialized defense.
