El Tribunal Supremo se pronuncia en casación sobre la legitimación de la Administración tributaria para dirigirse de manera directa al contribuyente obviando la figura del sustituto del contribuyente. La caracterización del contribuyente y del sustituto del contribuyente que realiza el TS coincide con las definiciones de la Ley General Tributaria. Las dificultades que plantea la asunción por parte del TS de unas declaraciones legales que son meramente formularias se desvanecen a la luz de los conceptos normativos de ambas figuras subjetivas.
The Supreme Court of Spain ruled in cassation on the standing of the Tax Administration to directly address the taxpayer, ignoring the figure of the taxpayer's substitute. The Supreme Court's description of the taxpayer and the taxpayer's substitute coincides with the definitions in the General Tax Law. The difficulties posed by the Supreme Court's assumption of legal statements that are merely formulaic vanish in the light of the normative concepts of both subjective notions.
