Seguridad nacional versus libertad de información:: la información clasificada y la investigación histórica en España

    El artículo analiza los obstáculos que presenta la regulación de las materias clasificadas en España a la luz de los desarrollos normativos más recientes y, en particular, del Anteproyecto de Ley de Información Clasificada presentado por el Gobierno en agosto de 2022. El estudio inserta estos desarrollos en una tradición de desequilibrio entre la protección de la seguridad nacional a través del secreto de Estado y las garantías a la libertad de información, insuficientemente protegidas en el ámbito normativo y aquejadas igualmente de una marcada carencia de recursos humanos y materiales en los sistemas archivísticos del Estado. El análisis incide en los efectos negativos que esta realidad proyecta sobre la investigación histórica, en particular, la que explora la Guerra Civil, la Dictadura de Franco, la Transición y la actual Etapa Democrática, con repercusiones igualmente limitantes sobre el fortalecimiento de la democracia y la implementación de las leyes de Memoria Histórica y de Memoria Democrática.

    In this paper we analyze the obstacles presented by the regulation of classified matters in Spain in light of the most recent regulatory developments and in particular the Draft Law on Classified Information presented by the Government in August 2022. We insert these developments in a tradition of imbalance between the protection of national security through State secrecy and the guarantees of freedom of information, insufficiently protected in the regulatory field and also suffering from a marked lack of human and material resources in the archival systems of the State. The analysis focuses on the negative effects that this reality projects on historical research, particularly that which explores the Civil War, the Francoist Dictatorship, the Transition to Democracy and the current Democratic Stage, with equally limiting repercussions on the strengthening of democracy and the implementation of the Historical Memory and Democratic Memory laws.
