Resumen de Las "Verwaltungsaufgaben": las funciones o tareas administrativas en el Derecho público alemán

La ausencia de un concepto de funciones o tareas administrativas delata la escasa relevancia doctrinal del dato primario de que el sentido de la ejecución de normas por la Administración es cumplir funciones, satisfacer tareas. La discusión acerca del modo de afrontar este vacío pasa por estudiar dicho concepto allí donde ya está consolidado.
Es el caso del derecho público alemán a través de su noción de Verwaltungsaufgaben.
El análisis revela que las Verwaltungsaufgaben tienen por misión, además de legitimar, describir, y ser parámetro de control del poder público, configurar la actividad administrativa. El análisis invita también a entablar una discusión en ambas jurisdicciones acerca de la relación entre las funciones o tareas administrativas y los presupuestos fundamentales de la actividad de la Administración.

The absence of a concept of administrative functions or tasks reveals the scarce doctrinal relevance of the primary fact that the sense of the public Administration executing rules is to fulfill functions, to satisfy tasks. The discussion on the way to address this gap involves studying this concept there where it is already consolidated.
It is the case of German public law through its notion of Verwaltungsaufgaben. The analysis reveals that the mission of the Verwaltungsaufgaben is not only to legitimize, describe, steer, and be a parameter to control public power, but also to shape administrative activity. The analysis also invites to open a discussion in both jurisdictions on the relationship between the administrative functions and the fundamental preconditions of the activity of the Administration.
